Bedford Hills resident claims he was illegally arrested by ICE

ICE: ‘Enrique Lopez Perez in the United States against immigration law, and would not have been taken into custody in error’

MOUNT KISCO – A Bedford Hills man seeking asylum in America claims he was illegally arrested by immigration agents in April.Eyewitness video from April 14 of this year shows Enrique Lopez Perez being arrested before he was set to start his landscaping shift.

According to Lopez Perez's attorney, immigration agents were allegedly looking for a different person when they bumped into Lopez Perez and their friend.

"They asked us if we had American papers. We said no, we answered no," Perez said through his translator.

According to a translator they did not tell Lopez Perez why he was under arrest.

Lopez Perez is seeking asylum from Guatemala and he says he was taken to Orange County Jail where he was held for nearly three months in poor conditions.

"I don't know what happened but I feel like my eyes are burning and I also have pain in my lungs. The mattress or the bed frame is metal," Lopez Perez said through his translator. "I don't think that working is a crime and if it is a crime then there's no solution for life.”

Hearing Perez story, the lawyers at Neighbor's Link in Mount Kisco got involved.

Immigration Attorney and Director of Legal Services for Neighbor's Link, Karin Anderson Ponzer helped pay Lopez Perez's bond to free him last week after she claims her client was illegally detained by ICE.

"There was no warrant and there was no probable cause," Ponzer said.

A representative from ICE released a statement on the situation.

Enrique in the United States against immigration law, and would not have been taken into custody in error.

An immigration judge has granted Enrique an asylum hearing as he attempts to stay in America.
