Yonkers PD: Dishwasher stabs cook to death at upscale restaurant

Francisco Smile Nicasio-Ramiez, 22, accused of killing 54-year-old Rafael Pena


Yonkers police say a man was stabbed to death Tuesday just before 5 p.m. at the upscale Dia & Noche restaurant on McLean Avenue.

People say the area is very safe that they walk every day and have also gone to the eatery and are shocked by the incident that happened inside.

Sources say the dishwasher got into an argument with the cook inside the kitchen and then the dishwasher stabbed the cook to death.

Yonkers police arrested 22-year-old Francisco Smile Nicasio-Ramiez of Queens.

Police say Ramiez used a kitchen knife to kill 54-year-old Rafael Pena.

Sources say a fight between the two broke out in the kitchen while the restaurant was open and staff dragged Pena to a car to get him to the hospital.

Detectives are still interviewing witnesses and reviewing surveillance video to try and figure out why this happened.

Ramirez is charged with manslaughter, which is a felony, and he will face a judge for his arraignment Wednesday at Yonkers city court. As for this stabbing it's still under investigation by the Yonkers police.
